A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §18B-14-3, relating to requiring an institution of higher education to allow an event involving the sale of firearms and ammunition to take place on the institution’s campus if such events were held at the location when the site was previously owned by the National Guard Armory.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §18B-14-3, to read as follows:

ARTICLE 14. Miscellaneous.

 §18B-14-3. Events involving firearms and ammunition on former National Guard sites.


Notwithstanding any other provision of this code or any agency rule to the contrary, an institution of higher education shall allow an event involving the sale of firearms and ammunition to take place on the institution’s campus, if the following criteria apply:

(1) The institution of higher education allows other outside organizations or groups to rent or host events at the intended site of the event involving the sale of firearms and ammunition;

(2) The intended site of the event involving the sale of firearms and ammunition was once owned by the National Guard Armory; and

(3) When the intended site was owned by the National Guard Armory, events were held at the site involving the sale of firearms and ammunition.

 

NOTE: The purpose of this bill is to require an institution of higher education to allow an event involving the sale of firearms and ammunition to take place on the institution’s campus if such events were held at the location when the site was previously owned by the National Guard Armory.
